PURPOSE

These General Terms and Conditions of Sale define the terms under which Venteronics offers for sale the products on its website www.venteronics.nl, and the rights and obligations that apply, without restriction or reservation, to all transactions carried out via this site.

Venteronics reserves the right to amend these conditions at any time. Any changes will be binding from the time they are posted online and will not apply retroactively to previous orders.

BUYER

These terms apply exclusively to buyers who are consumers located within the European Union.

Before placing an order, the Buyer declares:

• That the purchase of products on www.venteronics.nl is for non-professional, personal use only;

• That they have the legal capacity to enter into a contract.

ORDER

4.1 PRODUCT CHARACTERISTICS – AVAILABILITY

The Buyer can consult the essential characteristics of the products before ordering. Product availability is subject to stock at the time of the order. Venteronics reserves the right to cancel or partially fulfill an order if products are unavailable.

4.2 CHOICE OF PRODUCTS

Buyers are solely responsible for ensuring the suitability and compatibility of the selected products with their needs.

4.3 FORMATION OF CONTRACT – ACCEPTANCE

Adding products to the cart, proceeding through checkout, and validating payment constitutes acceptance of these Terms and Conditions.

Contracts vary by payment method:

• Bank transfer: The contract takes effect once payment is received.

• Credit card: Payment is processed upon order confirmation and may involve 3D Secure verification.

• PayPal: The contract takes effect upon redirection to and confirmation via the PayPal platform.

An email confirmation will be sent and should be retained by the Buyer.

PRICES

5.1 APPLICABLE PRICES

All prices on www.venteronics.nl are listed in Euros, including VAT. Shipping fees are calculated separately. If a pricing error is identified, the Buyer will be informed and may choose to cancel or proceed with the corrected price.

Prices are subject to change and apply from the time of update on the website.

5.2 PAYMENT

Full payment is required at the time of ordering. Accepted payment methods include:

• Credit/debit cards (Visa, Mastercard, Carte Bleue)

• PayPal

• Bank transfer

Orders will be canceled if payment is not received within 10 days.

DELIVERY AND RECEIPT

6.2 DELIVERY TIMES

Products are shipped to the address provided. Deliveries typically take 2–3 working days from our EU warehouse. Shipping confirmation and invoices are sent via email.

6.3 RECEIPT

Orders placed before 4 PM (Mon–Fri, excluding holidays) are usually shipped the same day. Delivery timelines may vary by carrier.

6.4 QUALITY / CONFORMITY ISSUES

For damaged or incorrect items, contact customer service with a description and photographs. A return number will be issued. Products must be returned in original condition with all accessories.

Returns without a return number or in poor condition may be rejected.

RIGHT OF WITHDRAWAL

Buyers may withdraw from the contract within 14 days of receipt without giving a reason.

To exercise this right, notify us in writing (post, email, etc.). We will refund all payments, including standard delivery costs, within 14 days of receiving the returned goods or proof of shipment. Refunds are made using the original payment method.

Buyers must return goods within 14 days. We bear return shipping costs if the buyer contacts us first for a return label.

EXCEPTIONS

Withdrawal does not apply to:

• Unsealed items for hygiene reasons

• Unsealed audio/video or software media

FREE RETURNS WITHIN 30 DAYS

In addition to the legal withdrawal period, products can be returned within 30 days of receipt to:

Contact customer service first to receive a prepaid return label. Returned products must be unused, clean, and in original packaging.

WARRANTY

All products sold via www.venteronics.nl are covered by:

• Legal warranty of conformity

• Warranty against hidden defects

• Manufacturer’s warranty, where applicable

Some brands (e.g., VOTEC, Serious, Vermont) offer extended warranties of up to 10 years on frames.

Exclusions include:

• Misuse, negligence, or lack of maintenance

• Normal wear and tear

• Use not in accordance with product purpose

LIABILITY

Venteronics.nl complies with EU legislation. We are not liable for non-performance due to force majeure or Buyer fault.

We strive to ensure accurate and up-to-date information on the site but cannot be held responsible for errors, modifications, or third-party interference unless due to gross negligence.

INTELLECTUAL PROPERTY

All content on www.venteronics.nl (images, text, layout) is the property of Venteronics and protected by intellectual property laws. Any unauthorized use is prohibited.

PARTIAL INVALIDITY

If any clause is declared invalid, the remaining clauses remain in force.

NON-WAIVER

Failure to enforce any clause shall not be interpreted as a waiver of that clause.

APPLICABLE LAW

These terms are governed by Dutch law. Previously listed references to German or Canadian law are superseded by this applicable local jurisdiction.

CONDITIONS APPLICABLE TO VOUCHERS

1. Vouchers can only be used on www.venteronics.nl and are linked to the original recipient’s email address. Only one voucher per order.

2. Voucher terms (validity period, minimum purchase) are stated in the accompanying email.

3. Refunds are proportional in case of partial returns.

4. Vouchers do not apply to products from brands including Cube, Trek, Cannondale, ORBEA, Garmin, and others, nor to Electric Scooters and Venteronics Electric products.

ONLINE COMPLAINTS / DISPUTE RESOLUTION

You may file a complaint via the EU Online Dispute Resolution (ODR) platform or contact our customer service directly via email.

Venteronics.nl does not participate in arbitration before a consumer dispute board unless legally required.
